ASU gains right for more casual workers to convert to permanent20 July 2005Following on from the ASU’s successful campaign for casual clerks to be able to be made permanent, we have now gained the same right for casual administration and clerical workers in clubs, hotels and motels. If you have being working as a casual doing clerical or administration work in a club, hotel or motel you may also now have the right to convert to permanent. If you have been employed by an employer on a regular and systematic basis for a period of 12 months - and it doesn't have to have been continuous - you have the right to elect to have your employment converted to full-time or part-time employment thereby gaining access to job security, sick leave, annual leave, etc. From 1 July 2005, your employer has an obligation to notify you in writing within 4 weeks of you attaining 12 months service and you then you elect to convert or not, as suits your circumstances. If your employer fails to notify you of your right to convert, then you can advise your employer that you wish to be a 'permanent' rather than a casual employee. Your employer cannot unreasonably refuse your request. Full details of how to convert your employment status are contained in the Clerks (Club's Hotels and Motels) Award at clause 4.3.5.
